Terms of service

MoFusion builds and operates custom software and AI systems for businesses, and offers software on a subscription basis.

The scope, price, and timeline of any project or subscription are set out in the proposal or order we agree with you, not on this page.

You agree not to:

• use the service unlawfully, or to store or send unlawful content
• attempt to gain unauthorised access to the service or to other users' data
• interfere with or disrupt the service, or test its security without our written permission
• resell or redistribute the service unless we have agreed in writing
• reverse engineer the software, except where the law expressly allows it

We may suspend access if use of the service puts our systems, our other clients, or any person at risk.

You keep ownership of the data and content you put into the service. You give us the permission we need to host and process it in order to deliver the service.

You are responsible for having the right to use that data, including any personal data relating to your own customers. How we handle personal data is set out in our Privacy Policy.

We keep ownership of our software, source code, designs, and documentation, including anything we develop while delivering a project, unless the agreement we have signed with you says otherwise. Where a project is delivered to you, you receive the right to use it for your business.

Fees, billing periods, renewal, cancellation, and any service levels are set out in the agreement, proposal, or order we enter into with you. Those commercial terms govern your subscription or project.

Applicable taxes are added where required by law.

We do not promise uninterrupted or error-free service. Any availability commitment applies only where we have agreed one with you in writing.

Except where these terms say otherwise, the service is provided "as is". We do not give warranties that it will meet every requirement or produce any particular result.

To the extent the law allows:

• Neither party is liable for indirect or consequential loss, or for lost profits, revenue, business, or data.
• Our total liability for all claims arising in any 12 month period is limited to the fees you paid us in the 12 months before the claim arose.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.

Either party may end a subscription as described above. We may suspend or end access if you materially break these terms and do not put it right within a reasonable period after we notify you.

After termination you can ask for a copy of your data within a reasonable period, after which we may delete it.

These terms are governed by the laws of the Dubai International Financial Centre. The DIFC Courts have exclusive jurisdiction, unless we have agreed a different forum with you in writing.

We may update these terms. We will update the date above and, for significant changes affecting a subscription, give notice before they take effect.
